The terms for using the Tend website and free workspace, including the important limits on what Tend is.

Agreement to terms
These Terms of Service govern your use of the Tend website and the free workspace provided by Tend Health, Inc. ("Tend"). By creating an account or using the service, you agree to these terms. Paid use by healthcare organizations is governed by a separate written order and a Business Associate Agreement, which control in the event of any conflict.
Tend is not a provider of medical advice
This is the most important term. Tend is a follow-up service. It checks in with patients and escalates concerns to a care team. Tend does not practice medicine, does not diagnose, and does not provide medical advice.
Nothing produced by Tend, including a call, a summary, or a flag, is a medical opinion or a substitute for professional judgment. Clinical decisions are made by qualified people on the care team. In an emergency, patients should call 911 or their local emergency number.
The free workspace uses illustrative sample patients so you can see how the service works. It is for evaluation only and must never be used with real patient information.
Your account
You are responsible for keeping your credentials secure and for activity under your account. Tell us promptly if you believe your account has been used without your permission. You must be able to form a binding contract to use Tend.
Acceptable use
You agree to use Tend lawfully and as intended. You agree not to:
- Enter real patient information into the free evaluation workspace.
- Attempt to break, overload, or reverse engineer the service.
- Use the service to harass, deceive, or harm anyone.
- Use outputs as if they were medical advice or a clinical decision.
The free workspace
The free workspace lets you generate a limited number of sample call scripts and summaries each month. Limits and features may change. We may suspend accounts that misuse the service or that attempt to use it with real patient data.
Intellectual property
Tend and its content are owned by Tend Health, Inc. and protected by law. We grant you a limited, non-exclusive right to use the service under these terms. Content you submit remains yours, and you grant us the rights we need to operate the service for you.
Disclaimers
The website and free workspace are provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim warranties not expressly stated here. We do not warrant that the service will be uninterrupted or error-free.
Limitation of liability
To the extent permitted by law, Tend will not be liable for indirect, incidental, or consequential damages arising from your use of the website or free workspace. Nothing in these terms limits liability that cannot be limited by law.
Changes and termination
We may update these terms and will post the new date above. We may suspend or end access to the free workspace at any time. You may stop using the service at any time.
